What is Mediation
Mediation is a negotiation process which uses a neutral third party as a facilitator. Typically the mediator is well qualified by education and training to undertake the mediation.
Mediation is based on the principle of self-determination. It is structured in such a manner that the participants make decisions based on sufficient information and knowledge. The family mediator assists communications, encourages understanding and focuses the participants on their individual and common interests. With the help of a mediator, the participants explore options, make decisions and reach their own agreements.
A component of family mediation is full and accurate disclosure of all information necessary to arrive at a fair and reasonable settlement. Withholding of information concerning assets and debts can be a reason to terminate the mediation.
Mediation is a voluntary process. Either party may terminate the mediation at any time for any reason.
The mediator does not represent either participant in a dissolution or divorce. He or she helps them arrive at an agreement. The participants are encouraged to seek independent legal counsel prior to finalizing their divorce.
